These Terms of Service (“Terms”) govern access to and use of the websites, applications, and related services operated by Kind Finance at https://kind.finance (collectively, the “Service”). By creating an account, clicking to accept, or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.
1. Eligibility and accounts
You must be able to form a binding contract in your jurisdiction to register as a parent or guardian. You are responsible for all activity under your credentials and for invitations you send to family members. You must provide accurate information and keep it current.
2. The Service
Kind Finance provides software tools for families to practice money skills at home—including chores, allowances, savings concepts, lessons, and related features described in-product. The Service is not a bank, broker-dealer, or investment adviser unless separately disclosed in writing with appropriate licenses. In-product balances and simulations are not the same as FDIC-insured deposits unless explicitly stated otherwise in a regulated banking integration you separately contract for. See How balances work.
3. Acceptable use
You agree not to:
- Use the Service for unlawful, harmful, fraudulent, or harassing purposes.
- Attempt to gain unauthorized access to systems, other users’ data, or non-public areas.
- Reverse engineer, scrape, or overload the Service except as permitted by law.
- Upload malware or content that infringes others’ intellectual property or privacy rights.
- Circumvent parental controls or age-appropriate safeguards in a way that harms minors.
We may suspend or terminate accounts that violate these rules or present risk to the community.
4. User content
You retain rights in content you submit (such as photos or text). You grant Kind Finance a non-exclusive, worldwide license to host, process, display, and share that content solely to operate and improve the Service for your household (including showing submissions to linked parents). You represent you have the rights needed to grant this license.
5. Subscriptions, trials, and billing
Paid plans, free trials, renewals, cancellations, and refunds are described at checkout and in-product. Fees are processed by our payment processor. Taxes may apply where required. If you cancel, access to paid features may end at the end of the current billing period unless stated otherwise.
6. Intellectual property
The Service, including software, branding, and documentation, is owned by Kind Finance or its licensors and is protected by intellectual property laws. Except for the limited rights expressly granted here, no rights are transferred to you.
7. Third-party services
The Service may integrate or link to third parties (for example, authentication, payments, or market data). Your use of third-party services may be subject to their terms. Kind Finance is not responsible for third-party services.
8. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, KIND FINANCE DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.

9. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, KIND FINANCE AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO THE SERVICE OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT SHALL KIND FINANCE’S AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID KIND FINANCE FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS (US $100), EXCEPT WHERE PROHIBITED BY LAW.
10. Indemnity
You will defend, indemnify, and hold harmless Kind Finance from claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your use of the Service, your content, or your violation of these Terms, to the extent permitted by law.
11. Termination
You may stop using the Service at any time. We may suspend or terminate access if you breach these Terms, if we must comply with law, or if we discontinue the Service with reasonable notice where practicable. Provisions that by their nature should survive will survive termination.
12. Governing law and disputes
These Terms are governed by the laws of the State of Delaware, United States, excluding conflict-of-law rules, unless a different governing law is required where you reside. Courts in Delaware shall have exclusive jurisdiction, subject to mandatory consumer protections in your jurisdiction that cannot be waived. If you are a consumer in the EEA, UK, or another region with non-waivable rights, nothing in this section limits those rights.
13. Changes to the Terms
We may modify these Terms. We will post the updated Terms and update the “Last updated” date. For material changes, we will provide reasonable notice where required by law. Continued use after the effective date constitutes acceptance of the revised Terms.
